From a view of the original photograph, zoomed in, this would certainly appear to be an oak as Mark at M observed. Not sure if the leaves appear large enough or the leaf lobes pointed enough for red oak, but it is difficult to say; could it be Turkey Oak? Doesn't appear to be beech.

Form looked a bit red oaky to me and I think I have seen this species retain its leaves in winter, however, agree about the rounded not pointed ends to the leaf lobes hence the 'might be'.

If not Red Oak - something similar

The leaves look angular and broad rather than rounded and narrow, so I think Turkey Oak could be ruled out.

I wonder if it might be possible to get a close-up photo of the leaf shape as this would be helpful and a close-up of the buds would be definitive for Turkey Oak.
