Fungi ID needed

I have found a fungi growing at the bottom of a red oak tree today and I need help with the ID. I'm at a friends house in a place called Bank nr Lyndhurst in the New Forest. I'm concerened about it as the tree is only about 20-30 ft away from the house. The tree is protected with a TPO. Please can someone help with the ID? It's a dark yellow waxy cap, creamy yellow strait gills and clumping around the base of the tree. Any advice would be great.

To help find the observation, the link is http://www.ispot.org.uk/node/241308. The fungi has been identified as Honey Fungus, which may be bad news for the tree - see http://www.forestry.gov.uk/fr/INFD-8CYL33 for example. Time to call in the arboriculturists, I think.
