this bird is one of a pair which have had their nest half-way up a large oak tree; very protective of their eggs and young, they have driven off marauding magpies, jays, squirrels and on one occasion a carrion crow. The pair are usually together (the other bird is just outside the frame of this particular photo). This bird is the smaller of the two, so I think it is probably the female.
